By accessing and using our website (www.pinktreefoundation.org) and any third party apps/ links/ websites associated with our website, you agree to comply with and be bound by the following TOU or any subsequent versions of TOU. Further the User solemnly declares that he is a major at age in according to the Indian laws. In the event if the user disagrees with the TOU, then she/he is advised to stop using our website. Further if the said User continue using our website, then it will be deemed that the User has unconditionally agreed the TOU.

1.3 User:
Subscribers, User or any other similar terminology used under this policy are all in reference to the person who is a Donor/ User of the website and has registered himself/ herself on the App and is accessing or using the App and/or the Resources of the App.
1.4 Donor:
Donor shall refer to any individual, entity, or organization that provides funds, resources, or in-kind contributions to or on behalf of the Pink Tree Foundation in support of its mission, operations, or initiatives

Content, Information, Blogs or any other terminology used under this policy are all in reference to software, text, graphics, images, sound recordings, audio-visual works, and other materials provided by or on behalf of the Pink Tree Foundation.
2. Use of Website
The user may use our website for lawful, personal, and non-commercial purposes. You agree not to misuse the site in any way that could damage, disable, or impair its function or interfere with Pink Tree Foundation, any third party’s users’ rights.
3. Donations
Our Mission: To empower communities with access to quality lung health education, screening, and compassionate, patient-first care.
All donations made via the PinkTree Foundation website are voluntary and non-refundable. We use a secure third-party payment processor for all online transactions. Donors will receive a receipt confirming their contribution. Donations are used for the charitable activities of the Foundation in accordance with our mission.
The User upon clicking the payment gateway link the user will be redirected to the payment gateway website and in the event the transaction fails, and the amount is deducted from the account of the User, then excess amount deducted from the account of the User shall be refunded in accordance with the refund policy of the third-party payment gateway website. The User is advised to carefully read the refund policy of the third-party payment processor.
4. Intellectual Property
All content, logos, images, designs, documents, and materials on the website are the property of PinkTree Foundation unless otherwise stated. You may not copy, reproduce, distribute, or modify any content without prior written permission.
4.1 The User understands, acknowledges and agrees that this Website/ App contains material such as software, text, graphics, images, sound recordings, audio visuals work, UI/UX and other materials provided by or on behalf of Pink Tree Foundation (collectively, the “Content”). The Content is be owned by us or by third parties, and is protected by copyrights, trademarks, trade secrets, patents or other proprietary rights and that these worldwide rights are valid and protected in all forms media and technologies existing now and herein developed whether registered or not by Pink Tree Foundation or such third parties.

The User hereby indemnifies Pink Tree Foundation and its partners from and against any and all losses, damages, liabilities, actions, proceedings, claims and costs arising from the User’s use of the App/Website.
12. Limitation of Liability
Pink Tree Foundation will make reasonable efforts to keep its platform available to Users but is not liable for any interruptions or unavailability. Users are responsible for meeting the minimum technical requirements, and any service/features issues arising from their failure to do so will not be considered the fault of Pink Tree Foundation.
13. Dispute Resolution
In the event of any dispute arising between Pink Tree Foundation and the User, then in such a scenario, the parties agree to resolve the dispute through amicable settlement. If the dispute isn’t resolved within 30 (Thirty) days of any party initiating amicable settlement, then it shall be resolved through any Alternate Dispute Resolution Mechanism. The courts in Mumbai shall have sole jurisdiction in the matter.
14. Governing Laws.
This TOU will be subject exclusively to the laws of India.
